Florence Apartment Housing Society Members seek justice

JAMMU: “We have been cheated by Gopal Ansal from Ansal Buildwell and his associates Rajeev Kalia, Rajeev Chawla, Chetan Gupta, Vishal Sahgal and others. They have taken the payment for the flats but it’s been seven to eight years now that they have not given the possession of the flats. We are 72 families of Jammu who had invested in Florence Apartment Jammu at Trikuta Nagar extension,” Vice President of Florence Apartment Housing Society, Dr Jagjeet Singh told reporters, here on Wednesday.
“Kulbhushan Gupta of Sansar Group Mills in collocation with Ansal Buildwell Ltd advertised for the sale of flats. A total of 72 buyers were lured to book the flats on their names,” he said.
“The needy buyers booked the flats and made full payment as per terms and conditions of the promoters. The project was to be completed within two years i.e, 2010 and possession along with transfer of registrations was to be made within this period. Kulbhushan Gupta with his malafide intention utilised the money so collected from the buyers in purchasing other land instead of completion the construction of the said project,” Singh alleged. “In the allotment letter it was mentioned that the cost of the flat is to be deposited in the name of Kulbhushan Gupta on the account of Florence Apartment and it was promised that flats will be completed within specified period,” he said adding that after collecting Rs 20-25 crores from buyers the company instead of completing the project utilised the money in increasing their business elsewhere and project was delayed for seven to eight years, leaving the buyers in waiting till to date.
Although, he said, the construction of structure is now complete but lot of deficiencies amounting to Rs. 3 crore are still pending and possession so promised has not been given to respective buyers.
Singh alleged that a total of 45 applications have been submitted in the Office of Crime Branch Jammu against Kulbhushan Gupta but nothing has been done in this regard, he added.
The buyers urged State and Central Government to act accordingly and save buyers from their agony/further losses.
They appealed to government to blacklist the firm, Ansal Buildwell Limited in all the states of India, to force ABL to handover the possession of flats to the buyers after completing pending work, to book the defaulter under PSA Act and to adopt the Real Estate Bill passed by the Parliament and appoint executive agencies as well as police to book such defaulters and put them behind the bars.
