HC denies bail to 4 employees in SBI ATMs theft case

JAMMU: Jammu and Kashmir High Court on Saturday rejected bail to Suresh Kumar, Sunil Kumar, Pawan Kumar, son of Nek Ram and Pawan Kumar, son of Des Raj, who were allegedly involved in SBI ATMs theft case.
Justice Tashi Rabstan, after hearing both the sides observed that since the Challan has been produced before the Court of Chief Judicial Magistrate, Udhampur, it would not be appropriate and in the fitness of things to deal with the bail application at this stage.
“Therefore, it would be appropriate if the petitioners are directed to approach before the Trial Court for grant of regular bail. So far as the allegation of criminal conspiracy under Section 120-B of RPC is concerned, the petitioners would be at liberty to address the said issue before the Trial Court”, with these observations, the court rejected the bail application of the accused.
On June 8, Principal Sessions Judge Udhampur R S Jain had rejected the bail to the accused.
According to police report, on May 18, 2016, Jatinder Singh, Senior Manager, Jammu, Radiant Cash Management Service Pvt. Ltd. filed a written report with regard to misappropriation of cash from SBI ATMs, Udhampur.
On May 17, during the audit and verification, cash shortage was detected in the 15 ATMs to the tune of Rs. 2,52,77,900. Sahil Sharma and Vicky Kumar, two employees were found responsible for this route area. FIR 153/16 under sections 409/403/120-B RPC was registered in police station Udhampur.
