Do not violate SC ruling on tuitions: HC

JAMMU: In a petition filed by several government teachers, who usually go to private coaching institutions before and after the school timing, the Vacation Judge of J&K High Court Jammu Wing Justice BS Walia on Friday observed that Supreme Court has stayed the order of the Division Bench of State High Court banning private practice by the State Government doctors and tuition by teachers and the said position is stated to be continuing till date.
After hearing Sr. Adv Sunil Sethi with Adv Veenu Gupta, appearing for the petitioners, Justice Walia further observed that ban on private practice by the teachers in coaching centers is in derogation of the orders of Supreme Court.
Justice Walia issued notices to Commissioner/Secretary School Education Department and Director School Education Jammu and directed respondents to ensure that the orders of the Supreme Court are not violated in any manner.
Earlier, the Counsel for the petitioners stated that order dated August 11, 2005, in as much as it conferred right on the government to grant permission to teachers and doctors to engage themselves by way of self-employment or in the form of accepting part time employment in private coaching centers, two hours before the opening of school and two hours after closing the schools, was set-aside by the Division Bench in Public Interest Litigation and further submitted that the petitioners had challenged Order No.577-DSEJ of 2015 dated 25.10.2015 issued by the respondent No.2 whereby prohibition on private  tuitions by Government teachers has been imposed, being totally illegal, without jurisdiction and power, violative of order/judgment dated 18.11.2011 passed by this Court in WPPIL NO.6/2011 titled Vichar Kranti International & anor. vs. State of J&K & others and to frustrate the impending decision in SLP (Civil) CC No.9115/2012.
