Non compliance of Court order for 3 years DB directs Chairman SSRB to pay Rs 30,000 as compensation

JAMMU: A Division Bench of State High Court comprising Chief Justice N. Paul Vasanthakumar and Justice Dhiraj Singh Thakur on Wednesday directed Chairman Services Selection Recruitment Board (SSRB) to pay compensation of Rs 30,000 to petitioner for non-compliance of the directions dated 17th May, 2012 issued in LPA wherein this Court while dismissing the appeal filed by SSRB directed the Board to implement the judgment of the Writ Court within a period of eight weeks, directing State, respondents to consider the case of the petitioners in the writ petition for appointment as Physical Education Teacher.
The Division Bench after hearing Advocate Anil Sethi for the petitioner while Advocate Liaqat Ali appearing for the SSRB observed that contempt petition (LPA) No.5/2013 was filed for non-compliance of the directions of this Court and the respondents extended the benefit of the judgment only to those who have preferred the contempt petition and the petitioner Jagdeep Kour herein has been left out. “Therefore she also preferred this contempt petition”, the court further observed.
It was also observed that when the matter was listed on 5th May, 2015 counsel appearing for the Board extended assurance that the Court order will be complied within four weeks and on the said assurance the matter was deferred and it was directed that in default, Chairman SSRB will appear in person.
The Division Bench observed that today neither the compliance of the direction was reported nor the Chairman SSRB was present in the Court besides counsel appearing for the Board sought further time to comply with the directions of this Court.
Upon this, the Division Bench granted two weeks’ time from today to report compliance and for the delay in implementing the order of the Court for the last over three years directed Chairman SSRB to pay compensation of Rs. 10,000 for each year totaling an amount of Rs. 30,000. JNF
