DB directives on prohibition on sale, construction on ‘Khad’

JAMMU: Division Bench of State High Court comprising Justice Hasnain Masoodi and Justice Janak Raj Kotwal on Tuesday took serious note that despite adequate and reasonable opportunity state has not filed reply in PIL regarding inaction in implementing the Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010 in which earlier Division Bench stayed the sale and construction in the areas of water body and sale of land concerning the bed of the river and the land recorded in the revenue records as Khad.
In response, senior AAG S.S Nanda appearing for the State sought time to which, the Division Bench granted four weeks’ last and final opportunity to file reply.
In an application seeking vacation of stay order of sale and construction on Khad, Division Bench observed that it would be appropriate to deal with application only after State discloses its stand. It was further observed that in the meanwhile stay on the sale and construction in the areas of water body and sale of land concerning the bed of the river and the land recorded in the revenue records as Khad shall remain in force as on date to continue till next date of hearing.
