JAMMU: Principal Sessions Judge Poonch Jaffer Hussain Beigh discharged three alleged accused namely Jaswant Singh, Manmohan Singh and Gurvinder Singh who were challaned by the police in a kidnapping case and directed police to investigate the matter again.
Principal Sessions Judge Poonch observed that incomplete Challan has been presented against the accused before the court of District Mobile Magistrate Poonch on 29th April, 2014 in FIR No.42/2012 for offence under Section 366, 109 RPC against the accused persons for kidnapping the prosecutrix Shabeena Akther.
The Investigating Officer during the course of investigation has recorded the statement of the witnesses conversant with the facts and has also got recorded the statement of the witnesses under Section 164-A CrPC. Without completion of the investigation and without recovery of the prosecutrix the Challan has been produced against the accused or kidnapping of the said prosecutrix.
The Investigating officer has mentioned in the Challan that till it is found whether the prosecutrix is alive or dead then only further investigation can be taken on. Unless and until the complete Challan is not produced before the court it is not possible to frame charge against the accused persons without completion of the investigation of the case. PP is directed to get the investigation of the case completed in all respects within a period of three months and accordingly the complete investigation report be produced before the court of law.
