HC seeks report in Assembly Secretariat, MLA Hostels backdoor appointment

JAMMU: In a petition filed by S.K Bhalla seeking quashing the decision of the Director Vigilance conveyed vide Status Report filed in Contempt Petition (OW) No.39/2014 titled Prof. S.K Bhalla V/s Sheikh Owais Ahmed (IPS) whereby the SVO illegally/arbitrarily closed the complaint of the petitioner dated 4th March, 2014 seeking registration of FIR against respondent No.3 and 4 under Section 5(2) Prevention of Corruption Act for making illegal/backdoor appointments against the newly sanctioned posts in the Assembly Secretariat and MLA Hostels, Jammu/Srinagar.
In the petition petitioner sought direction to Director Vigilance to register an FIR against the Mohd Akbar Lone former Speaker and presently Minister for Higher Education and Mohd Ramzan, Secretary, J and K Legislative Assembly under Section 5(2) Prevention of Corruption Act Svt., 2006 by constituting a Special Investigating Team (SIT) to be headed by an officer not below the rank of Senior Superintendent of Police.
Justice Janak Raj Kotwal after hearing Advocate S.S Ahmed appearing for the petitioner, whereas Senior AAG Gagan Basotra for the state, observed that Sr. AAG stated that he was unable to produce the record as it was not clear as to which record is to be produced, granted time for producing the record with the observation that “it is made clear that record of inquiry (PE) conducted by the SVO is required to be produced in the Court on next date of hearing.
