CBI registers another FIR against revenue officials in Roshni scam

JAMMU: The Central Bureau of Investigation (CBI) Jammu has registered a case against Revenue Officers/officials and others in Roshni Scam.
According to FIR, a verification was conducted by vigilance organization into the allegations regarding bungling committed in the implementation of Jammu and Kashmir State Lands (vesting of ownership to the occupants) Act, 2001 (Roshni Act) in District, Udhampur. The verification revealed that land measuring 12 Marlas belonging to one Chanchal Dass, son of Basti Ram, resident of Sutain, Udhampur; land measuring 01 Kanal 13 marlas belonging to to Jyoti Parkash, son of Mast Ram, resident of Sutain Udhampur; land measuring 3 kanal 07 marlas belonging to Shadi Lai, son of Chandu, resident of Sutain, Udhampur falling in Khasra nos. 19, 25 have been ordered for vesting ownership vide order dated 03-07-2007. “The perusal of the case files pertaining to vesting of ownership to the above named persons revealed that the beneficiaries are not permanent residents of Jammu & Kashmir state and the files also do not contain their Permanent Resident Certificates. The verification concocted in this regard has further revealed that the said beneficiaries are not permanent residents of J&K State. The vesting of ownerships upon above mentioned beneficiaries are contrary to the provisions contained in section 8 (1) (a) of the Jammu & Kashmir State Lands (vesting of ownership to the occupants) Act, 2001. The verification has further revealed that concerned revenue officers/officials are prima facie responsible for illegally conferring/vesting ownership rights upon the said beneficiaries thereby by abuse of their official positions have conferred undue benefit upon them. Therefore, in pursuance to the directions of the High Court of J&K passed in PIL No. 19/2011, FIR No. 16/2014 of PS VOJ (now ACB) is re-registered against Chanchal Dass, son of Basti Ram; Jyoti Prakash, son of Mast Ram, and Shadi Lai, son of Chandu, all residents of Sutain, Udhampur and unknown officers/officials of revenue department Udhampur under sections 5(1 )(d), 5(2) of J&K PC Act 2006 read with section 17 of J&K State Lands (Vesting of ownership to the occupants) Act 2001 and section 120-B RPC.
