HC upholds PSA of J&K Bank employee involved in terrorist activities

JAMMU: Justice Dhiraj Singh Thakur of Jammu & Kashmir and Ladakh High Court Srinagar Wing upheld the detention under Public Safety Act (PSA) of Farooq Ahmad Misgar, who was working as an Assistant Cashier in J&K Bank Shalimar Branch, Srinagar and was affiliated with The Resistance Front (TRF), a terrorist organization.
Justice Dhriaj Singh observed that according to the grounds of detention, which on perusal, reflected that petitioner was working as an Assistant Cashier in the J&K Bank Shalimar Branch, Srinagar and that the petitioner was affiliated with The Resistance Front (TRF). It was further stated that technical inputs clearly suggested that the petitioner was in touch with Pakistan-based terrorist leaders and have been taking instructions through a variety of new communication technologies which were encrypted and very difficult to decipher.
Justice Dhiraj Singh further observed that the petitioner was working as a Cashier in the J&K Bank and, therefore, cannot claim that he is either illiterate or unable to understand the language in which order of detention and the grounds of detention were couched obviating the necessity of furnishing a translated version of the said documents in any other language. “Insofar as the legal obligation to read over the detention order and the grounds of detention to the detenue is concerned, has been fully satisfied,” the Court observed and dismissed petition thereby upholding the order passed by the District Magistrate, Srinagar, who, in purported exercise of its powers vested in it under Section 8 of the Jammu and Kashmir Public Safety Act, 1978 (for short, Act of 1978), has ordered detention of the petitioner with a view to prevent him from acting in any manner prejudicial to the maintenance and security of the State.
