Court denies bail for raising anti-India slogan

JAMMU: Principal Sessions Judge Kishtwar Bala Jyoti rejected the bail application of Mudassar Nazar, son of Aziz Mohammad, resident of Bagwan Mohalla Kishtwar, Tehsil and District Kishtwar who was arrested by the police allegedly promoting enmity on Eid-ul-Azha thereby maliciously insulting the nationality with criminal intention to disturb peace and tranquility and to hurt sentiments of the nationalists by raising anti-national slogans like- ‘Hum Kya Chahte-Azadi’.
Public prosecutor observed that Mudassar Nazar and Saqib Majeed have sought to be enlarged on bail as they have been arrested in connection with FIR No.218 /2014 registered at Police Station Kishtwar dated 6th October, 2014 under Sections 153-A 120-B/124-A RPC on the ground of allegedly promoting enmity on the auspicious day of Eid-ul-Azha. The Judge further observed that raising anti-national slogan is certainly to pollute the serene atmosphere of any place. Court note with pain that bruises caused by such events/elements during last Eid celebration have not healed as yet and any such attempt by any person is to cause ripples in the process of restoring peace in this sensitive station. Crime in such cases is not against any individual but against whole society. With these observations Court rejected the bail application of Mudassar Nazar and in case of Saqib Majeed whose age is stated to be 16 years should to be dealt under Section 13 of the J and K Juvenile Justice (Care and Protection of Children) Act. The Court observed that in view of the settled position of law accused Saqib Majeed, who is below 18 years of age, as per Matriculation certificate is directed to be released from custody in this case, on furnishing a bail bond and personal recognizance of Rs. 20,000 each.
