DB directs Commissioner JMC to comply HC for making Jammu neat, clean
JAMMU: The Division Bench of State High Court comprising Justice Ali Mohammad Magrey and Justice Bansi Lal Bhat on Wednesday directed Commissioner JMC and Health Officer to ensure compliance of the orders passed by the High Court from time to time to achieve the object of maintaining hygienic condition in Jammu City and for keeping the city clean besides providing pollution free environment. The Division Bench further directed Commissioner JMC and Health Officer to file the compliance report passed by the High Court from time to time.
The Division Bench issued directions in a Public Interest Litigation (PIL) filed by Deepak Singh Balouria and others seeking direction to the respondents to strictly implement the provisions of the Essential Services (Maintenance) Ordinance, 2001 to ensure a clean hygienic and healthy environment for the people.
Senior Advocate B.S Slathia with Advocate Meenakshi Slathia appeared for the PIL, AAG Seema Shekhar for the State and Advocate S.S Nanda represented JMC.
Earlier, the Division Bench of State High Court observed that in the larger public interest it is imperative to make such a scheme compulsory and to ensure that every household put its garbage outside the house which can be collected by the vehicle of the Municipal Corporation on periodical basis. Another reason for making the scheme (service tax Rs 100) compulsory is that the State Government cannot run without revenue and such services could be extended if corresponding fee is paid to the service provider performing these services.
