DB orders status-quo withholding demolition of Lodge

JAMMU: The Division Bench of State High Court comprising Justice Ali Mohammad Magrey and Justice Bansi Lal Bhat in a petition filed by owner of Imperial Lodge Madan Lal Gupta on Wednesday observed that controversy involved in the instant petition has a reference to a PIL pending in Srinagar and Jammu Wings of the High Court and therefore directed Registry to submit report with reference to order passed in PIL pending in Srinagar and Jammu so as to consider the matter and passed appropriate orders and directed that parties shall maintain status-quo on notice issued by the BOCA till next date before the Bench.
The Division Bench after hearing Advocate Vikram Sharma appearing for the petitioner further observed that while dealing with the similar issue, the coordinate bench of this Court at Srinagar Wing, had already passed order with reference to grant of opportunity to the aggrieved party to approach Special Tribunal for seeking relief against BOCA therefore, it shall be appropriate to avoid any conflicting order in the matter. The Division Bench directed Registry to place copy of order passed in PIL pending in Srinagar and Jammu Wings of this Court regarding subject of sealing and violation of master plan. JNF
