7 KANAL LAND SOLD ILLEGALLY; Grabber impersonates as owner before court; 3 charge-sheeted

JAMMU: A land grabber was among three accused charge-sheeted for impersonating as owner of land measuring seven Kanals at Chowdhi area in a court for its sale.
The main accused Shashi Kumar alias Makhnu, son of Nanak Dass, resident of Barian, Samba had allegedly hatched a conspiracy with Nazir Ahmed, son of Rakha alias Allah Rakha and Shamim Akhter, wife of Gaffar Hussain, both residents of Chowadhi, Jammu and managed photographs, Fard Intkhab Jambandi and Aks-Shajra of land.
Shashi Kumar impersonated himself as Deep Kumar, the actual owner of the land, before the Court. Nazir Ahmed and Shamim Akhter identified him as Deep Kumar before the Court.
The Crime Branch Jammu on Monday charge-sheeted these accused for grabbing the land fraudulently.
FIR 15/2012 under section 419, 420, 423, 465, 466, 468, 120-B RPC was registered on the complaint of one Deep Kumar son of Manhor Lal, resident of Bahu Fort, Jammu wherein he alleged that he was the owner and in possession of land measuring 7 Kanals at village Chowadhi, Jammu. Of this, 3 Kanal 12 Marlas, falling in Khasra number 1177 and 1 Kanal 12 Marlas, falling under Khasra number 1176 was purchased by him in 2005 and necessary entries were got reflected accordingly in the revenue records.
On 27th May, 2012, some persons approached him with a plea that they had purchased the land belonging to him.
Deep Kumar further alleged that two documents of sale deeds, both dated 24th May 2012, purportedly executed by him, one in favour of Nazir Ahmed and the other in favour of Shamim Akhtar were found received in the office of Sub-Registrar, Jammu for registration.
Deep further alleged that he never approached the office of Tehsildar concerned for the issuance of Fard, nor has he appeared before the Sub-Registrar, Jammu for the registration of the sale deeds etc.
During the course of investigation, it was found that Deep Kumar was owner of land measuring 2 Kanal falling under Khasra No. 1177 and necessary entries in the revenue records reflected in his name.
Shashi Kumar hatched a conspiracy with Nazir Ahmed and Shamim Akhter and managed photographs, Fard Intkhab Jambandi and Aks-Shajra of land of the complainant and transferred this by executing two Sale Deeds on 24th May 2012, one in favour of Nazir Ahmed and the other in favour of Shamim Akhter.
The sale deeds were presented before the Court of Sub Judge (Sub-Registrar) Jammu for registration on the same day. The accused Shashi Kumar posed himself as Deep Kumar before the Court who was identified by accused Nazir Ahmed and Shamim Akhter before the Court.
After establishing the offences under Section 419, 420, 423, 465, 466, 468,120-B RPC against the accused persons, the charge-sheet was presented before the court of CJM, Jammu.
