After 3 years, Cop booked for illegal confinement

JAMMU: After investigations spreading three years, State Vigilance Organisation on Friday registered FIR against a Head Constable, then posted at Dharamsal Police Station in District Rajouri for demanding Rs 40,000 from four villagers to arrange their bail and keeping them in illegal confinement for four days.
According to SVO, one Abdul Khaliq, son of Faqir Mohd, resident of Kote Kabu Mohra Renthal Tehsil Kalakote, Rajouri, who was arrested on the basis of complaint lodged under Section 107/151 Cr.PC and FIR 110/13 under Section 456/379 Cr.PC, registered at Police Station Dharamsal in 2013. He had lodged the complaint to SVO against Head Constable Khursheed Ahmed of Police Station Dharamsal Rajouri for demanding and acceptance of bribe.
The SVO verification revealed that the complainant Abdul Khaliq was residing alongwith his family in a tented accommodation at Kate Kabu where he had covered some portion of forest area for keeping his goats and sheep.
On October, 10, 2013, HC Khursheed Ahmed came to his locationm took the complainant Abdul Khaliq and his brother namely Auranzeb to Police Station Dharamsal, in connection with a complaint lodged against them and others and demanded Rs.40,000 from them for arranging their bail and kept them in illegal confinement for four days.
On this, Abdul Khaliq called his brother-in-law, namely Mohd Rashid who arranged Rs.27,000 from his home and handed over to him and after paying the said amount to HC Khursheed Ahmed, Abdul Khaliq alongwith his brother were produced before the Executive Magistrate Kalakote in complaint under section 107/151 Cr.PC.
Further verification revealed that again on Dec 30, 2013, Abdul Khaliq went to Police Station Dharamsal with a written complaint regarding threat given to him by one Kalu, son of Gafoor, duly marked by SP Rajouri to SHO Dharamsal. HC Khurhseed Ahmed tore the complaint and put him behind the bars and demanded Rs.5000 to Rs.6000.
Abdul Khaliq called his brother and brother-in-law to the Police Station , who on reaching Dharamsal Police Station, was also put behind the bars.
HC Khurhseed Ahmed released Abdul Khaliq’s brother and brother-in-law next morning.
Thereafter, Mohd Rashid brother-in-law of Abdul Khaliq arranged Rs.32,000 from his home and handed over Abdul Khaliq who after paying the said amount to HC Khursheed Ahmed was bailed out in case FIR No.110/2013 Police Station Dharamsal.
The aforesaid acts of commissions/ omissions on the part of HC Khursheed Ahmed of Dharamsal Police Station Rajouri prima-facie disclose the commission of offences under section 5(1) (d) r/w 5(2) and Section 4-A of P.C Act Svt. 2006. Accordingly, FIR.19/2016 has been registered against the accused official and investigations has been set in motion.
