3 acquitted in ex sub-inspector’s murder

JAMMU: Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Mohammad Bashir, son of Lal Din, Zahir Abass alias Gulla, son of Mohammad Bashir both residents of Village Mastandhara and Mohammad Iqbal alias Hamza, son of Hassan Mohammad, resident of Marhote, Tehsil Surankote District Poonch who were facing trial for the last nine years in murder of Sub Inspector as prosecution failed.
The case arises out of a report received through reliable source on 7th August, 2004 at 5:45 AM that some militants at the behest of Pakistan intelligence agency (ISI) shot dead the deceased Mohammad Bashir, a retired Sub Inspector of Jammu and Kashmir Police at Mastandhara during the night intervening between 6th and 7th of August 2004.
On receiving this information FIR No.127/2004 for commission of offence under sections 302, 121,123 read with section 120-B RPC and 7/25,26/27 I.A.Act was registered in Police Station Surankote. During the course of investigation vide Police Headquarter Order No.3792/2004 Dated 21st November, 2004 the investigation was transferred to Crime Branch Police Jammu. After completion of investigation Challan was presented.
Principal Sessions Judge Poonch after hearing both the sides observed that when there is neither direct nor indirect evidence against the accused persons, judicial process cannot be issued in the instant case against the accused persons as the prosecution has not succeeded in proving the guilt of the accused persons. With these observations Court acquitted all the accused from the charges. JNF
