JKNPP rips apart BJP MLAs Lawmakers blissfully ignorant of laws: Harsh

JAMMU: ‘Little knowledge is dangerous’ said Harsh Dev Singh, Chairman JKNPP and former Minister, while commenting upon the arguments given by the BJP MLAs in the Legislative Assembly yesterday while protesting over the issue of revocation of PSA on Yasir Alfaz, the person accused of desecration of temple in Janipur locality of Jammu.
He said that the BJP MLAs created a ruckus inside the Legislative Assembly yesterday claiming that PSA could be revoked only by the District Magistrate and that the government had no authority to issue any such order.
Ridiculing the ignorance of the said BJP leaders, Singh said that the BJP MLAs held the House to ransom over their flawed version of law without knowing the exact legal position on the subject.
He said that rather than making the government answerable for revocation of PSA on the offender without the report of Medical Board constituted for the purpose, the BJP MLAs chose to take the flawed logic that only District Magistrate could revoke it.
He regretted that the MLAs who are known as lawmakers built the foundation of their case on flawed premises with no one inside the Legislative Assembly to project the exact legal position before the House.
He said that even the Law Minister failed to correct and inform the ignorant MLAs that government alone had the powers to revoke the PSA order sec 18 and sec 19 of the Public Safety Act and not the District Magistrate. He regretted that the MLAs who make laws for the posterity were blissfully ignorant of the legal position on the subject on which they had raised a storm. Elucidating further Singh said that the sec 8 of the Public Safety Act provides that PSA has to be invoked by Divisional Commissioner or the District Magistrate to be further approved by the Govt. order sec 8 (4) and that it can be revoked at any time by the Govt. order sec 18 and sec 19 of the Public Safety Act. He said that District Magistrate had no powers to revoke PSA once slapped under sec 8 of the Act. He said that raking up an issue for discussion and disruption of proceedings on flawed version of law only goes to prove the political and intellectual bankruptcy of BJP and its half baked experts. He said that melodrama staged by the BJP legislators over the issue has only evoked cynicism besides rendering them as objects of contemptuous humorous disparagement.
Flaying the political imbecility of the BJP MLAs, Harsh observed that they ought to have questioned the Govt. as to why the PSA was revoked first and Medical Board constituted later, whether lack of mental stability was also a ground for revocation of PSA and if so under what sections and whether there were any precedents on the subjects and whether any offender had been granted immunity order PSA in the past due to so called mental instability. The BJP MLAs ought to have vehemently demanded the invocation of PSA against those who unfurled Pakistan and ISIS flags on Friday last and openly announced to intensify the anti India campaign, he added. He deplored that rather than raking up genuine and legitimitate concerns of the public, the MLAs indulged in ridiculous squabbles and nauseating, vague, silly assertions only to play to galleries thus making a mockery of themselves.
Ridiculing the un-informed BJP legislators’ for fiddling with law, Singh said that yesterday’s melodrama in the Assembly was another ludicrous chapter in the theatrical performance of BJP legislators who had earlier raised a lot of Jangle and rattle inside the legislature over their Salary, Plots, CDF, Powers etc.
Asserting that mental instability was no ground for revocation of PSA, Harsh further demanded the immediate booking of all conspirators behind the sacrilegious acts in the temple besides the separatists and others anti nationals who indulged in seditious activities on Friday last. Reminding the BJP of its opposition days when it would nail anybody and everybody at the drop of hat and create a storm over trifling, Singh lamented that it had now sold its soul for a handful of crumbs.
