10-year RI to three in attempt to murder case

JAMMU: Principal Sessions Judge Jammu Vinod Chatterji Koul on Thursday awarded 10 years imprisonment to Darvinder Kumar alias Raju, son of Om Parkash, Rakesh Kumar alias Sonu, son of Om Parkash and Ricky Sharma, so of Hem Raj in attempt to murder case.
According to prosecution, on June 18, 2006, Ashok Kumar, son of Shiv Ram of Lower Gadigarh, Tehsil Jammu, who was accompanied by his wife made an oral report in injured condition with the Incharge Police Post Gadigarh that he along with his family was in the compound of his house and Vijay Kumar alias Sonu, son of Chuni Lal of Lower Gadigarh was also with him, when the aforesaid accused came and attacked him and his family. Accused Raju was carrying a Kirch in his hand with which he inflicted injury in the abdomen of Vijay Kumar due to which Vijay Kumar suffered serious injury. He was lifted to hospital by a neighbour. He and his wife were also injured by the accused. On their hue and cry neighbourers came there and accused left the spot. On the said oral report, Report No. 14 was entered in the daily dairy dated June 18, 2006 of police station, Gadigarh. As the offence punishable under Sections 307, 452, 323 and 34 RPC and 4/25 Arms Act were shown to have committed, report was forwarded to police station Satwari for registration of FIR and accordingly FIR No. 94/2006 was registered.
Justice Vinod Chatterji Koul after hearing Public Prosecutor Rakesh Badyal for the State whereas Advocate Navneet Dubey for the accused, observed that keeping in view all the facts and circumstances and while balancing the aggravating and the mitigating circumstances, the ends of justice will be met in case all the accused are sentenced to undergo rigorous imprisonment for a term of ten years and also to pay fine of Rs. 5,000 each for commission of offence punishable under Section 307 RPC and in case of default in paying the fine, accused shall undergo further imprisonment of six months each. They are further sentenced to undergo imprisonment for a period of three years and also to pay fine of Rs. 500 each for offence punishable under Section 452 RPC and in case of default they shall further undergo imprisonment for a period of two months each. The accused shall also suffer imprisonment for a period of one month each for offence under section 323 RPC. Accused Darvinder Kumar alias Raju is further sentenced to undergo imprisonment for a period of one year and to pay fine of Rs. 1000 for offence under Section 4/25 Indian Arms Act, and in case of default in paying the fine, accused shall undergo further imprisonment of one month. All the sentences, however, shall run concurrently.
